The Structure of this Blog will Be Different

I recently received a communication from the News Tribune that I was in violation of the copyright laws because I had several times used their articles verbatim. Even though I would include my source The News Tribune and the reporter usually Jeff Dankert. They say it is also a violation to cut something from my private print edition and scan into this blog. They asked that I remove anything that fits into that description. I have gone through removed the scanned copies and the articles that were from the paper. Eventually I will remove all back links also.

I will continue to watch activity in the city and write my own opinions of what is taking place and will still accept your opinions. We have paid for and received the News Tribune for over 50 years in our home but that is now coming to an end and I will Not renew our subscription which is up in a couple of weeks. Several others I know well have also made the same decision. So feel free to inform us of anything printed that you would like to see brought to our attention. I thought that as long as I was giving them credit on the blog for what I used, it would not be a problem but I guess I was wrong. I will still use other news sources with backlinks to their papers.

Since the News Tribune stated that someone had brought it to their attention I do believe that this is politically motivated especially since it is happening one month before our municipal election on April 9. This is getting to be a very nasty election campaign and some of this is coming from incumbents and associates, some of whom have connections.

I would not take the newstribs word. Check with a lawyer on copyright laws. As long as you reference them and give them credit I would think you are in the clear.

If you publish (and postingon a blog is publishing) something that is copyrighted, and you don't have permission from the copyright holder, that's copyright infringement. It doesn't matter if you make money, or intend to make money. It doesn't matter if you state that the material isn't yours. If you publish someone else's stuff, without their permission, it's copyright infringement. You are allowed to publish very small bits of other works if you are doing so for education or parody, but you can't publish the whole thing.

What a shame. I guess we live in a town of intimidation. What kind of future is that if we do ????

So folks, what do you want for your city in the future and your vote in April, "a city run by the voice of the people or a city run by intimidation".
You know the name of the candidate that can take us to a brighter future (44 yrs of it)and you know the candidate that will keep us in Hell (4 yrs of it)to suffer some more.

Exercise your Right , VOTE !, make the right choice for your sake and that of your kids of the city of Peru. ( We don't need to pass on a GHOST TOWN to the next generation)

There have been many times where people have used the articles that have been in the paper to make reference to what they blog whether it's a question or just making a reference as to a topic. this has been done without the title being from the newspaper. I thought as long as a footnote is used as to where the information came from. It's perfectly ok. Like when doing a term paper back in the day. What has been reported on the radio also has been referred by blogger on here. Have they contacted you? Lois. Keep up the great job as being the administrator of this blog. Suggestion: contact an attorney outside this area and see what they say about the correspondence you had with the paper. Enjoy this nice day.

Yes you are referring to a candidate who served 44 years but he was a young man when elected and needed that long to accomplish what he did in Peru. None of the candidates logically have 44 years and things have changed so much in 4 years, different laws, different businesses, different environment. He can't pick up where he left off 4 years ago.

We have other choices beside our current mayor.
Songs have been written, books have been written and movies made about that topic and people attempting to return to somewhere or a time in their life and it just doesn't happen and work out.
One of the things that would not change or at least I don't think so would be the Building Inspector Taylor, City Atty and Chamlin Engineering. Those are the things so many complain about so often and were also prominent in the last Baker administration.

There is enough news worthy information pertaining to Peru that you really don't need to repost the NT articles.

First goal of a business is to make money. Second goal of a business is to make more money, etc. Perhaps this is why blogs have become such an important forum because their goals differ in degree from news media and how/what information is presented to the public.

Your blog, your ideas, your articles of public interest and Lois trust me the information that is necessary the public review prior to voting is definately abundant and not always reported by
news media.

FYI: Once again the Extreme Pyrotechnics contract for the 4th of July fireworks will be discussed at Tues. March 12th's rec board meeting. This contract was supposed to be finalized in September. I guess when you don't have a contract and you don't go out for bid it's much easier to handle because there is no paper trail.

And report back to us. Maybe the attorney in which you speak with can come on this site and educate us as to the true law! It would be good PR for the attorney. At Wed. council meeting alderman Potthoff couldn't brag enough about the work being done by the economic developer and the amount of hits and progress our new informational web-site was producing. He made it sound as though we were moving forward with development of businesses and possible industries. Then, in the very next day's news tribune there was an article regarding the dissatisfaction of Unytite with the electric rate increase and the possibility they may relocate. Several days later another article indicated that more businesses are greatly concerned about Peru's electrical rate increases. Come on aldermen , tell it like it is.

Lois, Thank you for informing the citizens of Peru for local information which the newspaper at times has not. I, as a individual feel more informed of the entire activities of Peru reading the blog than what little I recieve from the local newspaper. Also the blog has been more accurate. There is always a little picture and a big picture to all issues.
The littler picture is a upcoming election which involves a local city official or local city officials and most likely a former employee of a local news source which has a 18 mile monopoly.
The big picture is not this source of communication and its bullying methods but the freedoms which people such as yourself have made great sacrificies to obtain for these money making machines who now claim exclusive rights to inform others. Sad to say their are entire countries controlled by a few with this same idea. We are all aware of the countries because of our troops continuous involvement to obtain freedom for them.
This action by the local newspaper is no different than if we lived in a government controlled press. It is saying that they are to be the sole establishment to develop all opinions of the area. This opinion is not restricted to politics, which in this instance is its goal but is open to it controlling the ability to have a continuation of Freedom of all and anything including our thought process.
Realizing the bankroll that one must have to fight the medias organizations and insurance companies I suggest that you at first have a committee formed of close allies and set up a short and long range plan. Remember there are two kinds of cats: One that has nine lives (us) and the other which has more than one wasy to be skinned (them). I tried to call the news trib to cancel my subscription but the automated phone system told me they were experiencing a high amount of call and to leave a message, I hung up, I want to talk to someone in person. I will be calling back News Trib! This whole issue smells fishy! Stand up for what is right NT subscribers, call and let them know how you feel.

This has a bad smell to it. Who noticed 75cents on feont page of paper? Was 50cents. Subscriptions must be down. Bought a paper from a machine two days ago. However on vending machine it was still 50cents. Only had to pay 50cents. Ottawa Times is a great paper.

You bet your last penny I will not be spending approximately $182.00 a year on the news tribune paper. I work 2nd shift and get that paper from a vending machine 6 days a week for 52 weeks in a year on my way to work and read on my breaks. BEEN DOING THIS FOR 15 years. Done! No coupons either like the Chicago Tribune.

Was going to get a paper today, not!!!!!! Will put that money into my piggy bank. 100% serious. Go to a coffee house and read for free! Somebody was saying that if someone has a subscription for paper on net, they can give their password to friends who than can log on and read for free. Don't know if this is true. If true. Imagine 20 people who subscribed to paper, cancelled their subscription, and all those 20 were friends with the one person who has subscription on net, and was able to read paper for free. Again, not sure how this works. My opinion the news tribune isn't worth reading for the cost of it.

Lois, its not a freedom of speech. Its simple copywrite laws. What stops you from placing a entire book on the blog? Its the copywrite laws and those artists or writers own the work. If anybody believes that the accuracy of blog writers has a higher standard than newspapers, then you deserve to be the next blog topic. Just write the news as you see fit, don't copy articles from any publication. Its the law!

I was aware I needed to give credit and I did except for the one where I took my information from my bought and paid for N.T paper and that was the information about the mayoral candidates. I thought it was my paper and could do that. Joyce McCullough called me and we talked about it and she said she wasn't absolutely sure about right and wrong. I then began to remove some of the postings and the one of my paper I added my source.
Yesterday I received the letter of information.
Students make reports all the time using a mulititude of sources and all that is needed is a footnote noting source. She mentioned that people that use news stories like TV and radio have what is called attribution and I believe that is like paying the news source so much for being able to do that.
When I started this blog I did everything on my own and did not use any of their information and I can do it again. I have friends who can video meetings and I can tape them since I don't own an IPAD, (not in my budget)
We will find the information without reading the paper.

You are absolutely right but in the case of using the share it options and sending the receiver back to the NT with a link back. I quit using that option because so many people could not read what I was referencing because they only allow you 5 views per month unless you are a paying customer. I think the Ottawa Times gives you 10 views.

I would think you could do that. I don't see it being any different than cleaning your cache and cookies everyday and putting your user name and pw in each time you want into the site. If you are comfy sharing with others, I think it would work. Now with all the portable devices used, how would a web site know who was logging in if the correct information was given. Does anyone know for sure if that would work?

We can respect this. So. Bloggers can still make references to what they have read in the paper????? Correct? As long as they don't quote it? The Fair Use exemption of copywrite law is tricky and not something that I think is worth Lois running the risk of retribution. Newspapers do have full copywrite protection, just as they also have the right to allow usage of their articles when requested. There is a fair use case for this blog on educational and public service grounds. Many papers allow accurate reporting of their content, particularly during elections, as a public service and to enhance their investigative journalists exposure and reputations.
It is more telling to note that the paper has been strongly criticized here, and is strongly tied to individuals in power in this small kingdom. It is not surprising that they, and the affected politicians, do not want their weak and misleading articles posted directly above comments that often illustrate the bias, lack of investigation, and occasional bald lies. With the increase in views that blog is getting, many of the incumbents want to maintain as much fog around their records and mistakes as possible. Mr Vickrey was deeply damaged not by the blog or the newspaper, but by a cutting and incisive commentary published in the NT directly before the election.
With this Mayoral race in particular, there have been so many embarrassing issues that Harl is counting on dilution of the opposition votes and a blur of criticism. Nothing focused. Some times the best defense for crooks and bad politicians is to steal in broad daylight, so everyone just gets used to it, says it the way the system is. Just look at the township as an example.

What a disgrace! The NT will NOT be seeing me renew my subscription. You can bet the house on that!!! I was reluctant to subscribe this year when I found out how little to nothing they pay they their employees. The Miller family has taken advantage of MANY!! Being that they pretty much have a monopoly you would think they would have enough cash to pay their employees above poverty pay. I know a few people that work over there and for how hard they work and they hours they put in, it's a crime!!! Did I mention these employees that I know are college educated... On top of that they pay the "stuffers" a whopping 1 PENNY per paper. Stuff 300 hundred papers make a whole $3.00. Did I fail to mention they are just like Peru politics and I have heard rumors that their "favorites" get their houses paid for. Can someone confirm this? The News Tribune and the Miller family can kiss where the sun don't shine for all I care.

This is the proprietary work of a local business, and you actually do not have a right to read it for free.

Post a clip of a Disney movie and see what happens if you do that over and over again. Better yet, next time you watch a movie read the small print at the end.

8:45 I would guess that you and I are on different sides of most issues, but I do generally agree with you on this one, at least with the wisdom of her decision. There is strong copywrite case law support where the NT has legal right to challenge the reporting of their work on this blog.

But do not just dismiss the Fair Use argument in this case, because your analogies do not directly hold up. Segments of public news stories have been allowed in such case law in instructional situations, and particularly during news stories of high public interest, with appropriate citation.

These are not Disney movies, and the Tribune is not solely an entertainment entity. What is more curious is this decision and it's timing, by a newspaper that supposedly is unbiased and printing news for the good of it's subscriber base. If I were the editor I would offer an easy mechanism to simply request reprint authorization on a public service blog. The publicity and sharing of your news stories should increase your subscription base.

The argument could also be made that individuals are allowed to reference an article in the paper, and the article is already available simply by doing a google search. In that case, Lois would only be passing on the online Google content, as a portal and not the actual distributor of the publically available content. A publisher cannot essentially hand out millions of copies of free content, then arbitrarily start suing individuals for sharing it. If they sue her, they need to sue every major search engine or totally lock up their site.

So you see, as I said before, if the paper takes it to trial there is defense. But there is no defense for the timing of the decision, adding to the long list of Illinois Valley retributions against anyone who speaks up.

A campaign or online petition to request that the NT open up political items for repost on the blog, supported by a campaign to boycott the paper, is a valid protest, whether you think it advisable or potent. Some of us have been advised by our counsel to post anonymously on the blog because of the high likelihood we will be either parties to, or asked to give deposition in, pending litigations with the city of Peru. Not everyone posts anonymously because they want to scream in caps and shout unfounded allegations. Many must do that, or remain silent.

The leaders of Peru operate without fear of being sued, because it is very difficult to sue most governments and win. But if you keep arrogantly kicking individuals around long enough, they will rise up and fight, whether they win or not. And not everyone in those walls of City Hall like what has been going on there. They have to feed their families, and don't want to have rocks thrown or worse.

Unlike the mayor and many of the business owners, not many of us want to fight. But make no mistake, unless things change it must happen.

Interesting 9:29, but the NT does not hand out millions of copies for free. They allow 5 online views per month/per device for free and expect individuals to purchase a subscription after that. The NT does not print for the good of the subscriber base, they print to generate a profit.

Copying an article in whole or in part without proper citation breaks the rules of fair use. Purchasing a copy of the newspaper for $.75 does not give an individual license to plagiarize the works within that edition. Proper citation is always necessary.

I am sure this decision was politically motivated but the idea that it was for retribution is absurd. The NT has to be seen as unbiased as possible, especially during elections. The NT expects to conduct interviews with candidates and sell them advertising space. The NT then expects individuals to purchase their newspaper to see what the candidates have to say. With the blog owner choosing to select articles and excerpts that favor her views, it could make it appear to some that the NT is biased. Also, the blog owner does not always do a very good job of distinguishing where the NT article ends and her opinion begins and that also makes it appear that the NT is biased.

I could also see the NT getting pretty tightly wound over sharing of online accounts as an earlier poster advocated. That is stealing. If you want to share a physical copy of your newspaper with your neighbor, there is not much NT can do to stop you, but most websites that sell online subscriptions have safeguards to prevent the electronic equivalent.

I did not choose articles to my point of view, they were always something of interest to the residents here in Peru. It gave them an opportunity to comment on the content and the articles were not something that I particularly liked or that favored my point of view.
My whole point of maintaining this blog has been to open up government and to inform the people so they can make better decisions at election time. Sure I favor one candidate over the other and I will always give my reasons why I have chosen him/her to vote for. But I also respect peoples right to make their own choices.
I don't think I will get anyone who believes that our city has always run an open and honest city government and welcomed citizen input. If I can get a small percentage of residents to become aware of what is going on my purpose has been accomplished. If the NT had done this through the years, this blog and others would not have come into existence.

Google any article in the paper. Like many online papers, access is not restricted if you just use a search engine.
The limit you speak of is only if you portal their site .

There is no way to lock down online access to a newspaper unless you completely lock it down. Newspapers do not do this because, they like the exposure.

This would be a key element in any legal defense if the News Tribune made any formal motion against Lois. It is hard to claim foul against one individual, when you allow the world access to your content as a sample in similar fashion.

Lois is not reproducing the paper, she is presentIng small segments of it under a Fair Use provision of the copywrite act.

Why do you think there hasn't been a township election article? Biederstedt is running Harls campaign and the township trustees campaign keeping them out of the press because the idea of a 2 90 years old trustees giving an interview wouldn't go well. Party politics have no place in local elections and Lois keep posting the links there is nothing wrong with that. The problem they have is they can't keep up with the times in fact of they don't like it the should remove the share link on everyone of those articles. My subscription will be canceled on April 10th because I want to read "Harl out!!!Hart new Mayor of Peru!" so I can post on my wall.

I've never heard or read of so many childish games being played in a city by city official, which is quite obcious has happened. Honest people would not be making a deal of this. FACT! the news trib is strongly influenced by the crooked politicians of peru, always has been always will be. the BCR news is 10 times the paper the news trib will ever be and its only published 3 times a week. if you run ads with the news trib be prepared to take out a loan because they rape you, the BCR is reasonable and works well with organizations on pricing also. 12:27. Correct. A person owning a small business can't even afford to advertise in the paper. Just look at the small businesses in the area and you never see advertisement. Restaurants alot of times have one day a week ad,. To put a help wanted ad, you gotta take out a loan for crying out loud. Why don't the have coupons in sat paper like the Chicago trib.!!! ?

Why is the paper charging for help wanted ads? For years this area has been suffering from hard economic time and I thought the paper was donating the space to employers to promote a job program. Only made sense because the more people working the more people who could afford the paper.

That is the biggest rip off I have ever encountered, particularly for a small town, less than desirable newspaper (if you can even call it a newspaper). If it doesn't make money or match their opinion, it simply does not make the paper.

About 7 or so years ago the paper would put one day of a obituary in for free, more than one day was outrageous if I remember correctly. Sad, a person passes away and has paid for newspaper for 40,50.60 years, and they still want more money. I don't know the papers policy and costs for obituaries. Unbelievable.

Having recently gone through the obituary fiasco, I was informed by the funeral director that the obit had to follow their format or they wouldn't print it!!! Charge (big bucks), but do it my way...what kind of a paper does that? Further...maybe they need to realize that a large portion of their subscriptions are from people who only subscribe to see the obits to see who of their friends have passed away. If it were not for people wanting to be informed, I truly feel that their subscriber base would be considerably lower.

I have a friend who does not get the News Trib but online and she is able to view the obits, but nothing else. My subscription expires next week, so then I will find out if I can view. I was also told and I don't know if this is true but that the "greenies" they throw out to non subscribers are considered part of their circulation base.

Whether you like it or not, copyright laws say that y0u can't reprint someone elses work for an unlimited amount of people to see. It is not a law that Scott Harl wrote to be able to control this blog, it is a law to protect writers, musicians, etc. from having their work stolen with no compensation.

Yet many on this blog claimed that it was because of him that the News Tribune stopped the use of their articles on this blog. The easy thing to do when there are things that need improvement is to search for a scapegoat on which to lay all blame and publically revile them. It is much harder to assess the situation and look for solutions. Perhaps a new mayor is what Peru needs to revitalize, but the problems Peru has are hardly the fault of a single man, and I don't think they materialized suddenly in the last four years. These problems were in the making for quite a while. Let's look for a solution, which might include a new mayor, instead of a scapegoat.

thank you and that is a point I try to make but it is hard to make people believe that the deep seated problems of Peru did not develop in 4 years. They all have their roots in the past which was not as rosy as some people are trying to present to the public.

The statement was that no one would give Scott Harl credit for writing copyright laws. It WAS NOT stated that he through political connections WOULD NOT stop the use of political articles printed in the news trib from being reprinted in this blog. Huge difference between writing copyright laws and using political influence inproperly.
