I think this might be better than No Trespassing, seems to fit the decisions Peru has made about this park.

Given the protruding bolts, I don't think the city had much choice about shutting it down and keeping kids out. I do not think it necessarily reflects a permanent decision made outside of the legal meeting procedures on display tonight. Of course, we would need to see a lively debate at the meeting, with details presented by the aldermen. Otherwise, this shut down of the court might be used in a case suggesting more violation of the OMA, with decisions being made outside of the council meetings. Similar to the Venture drive case.

As it stands this action could be used to counter the initial presentations that the nets were portable, and the game could easily be ported from one location to another. This would throw into question the legitimacy of the initial three year trial, since it appears that the simple installation of the alleged trial makes the location a defacto permanent pickleball court.

Given the apparent deception used in the introduction of the sport, it opens up the originator of the request to being sued for fraud, with legal injury being suffered by the park neighbors, and even the city, since they allowed it under false pretense.

Fraud:

A false representation of a matter of fact—whether by words or by conduct, by false or misleading allegations, or by concealment of what should have been disclosed—that deceives and is intended to deceive another so that the individual will act upon it to her or his legal injury.


I believe that another blogger once gave their expert legal opinion that the case would be thrown out immediately. It is my sincere hope that he/she is the legal counsel the city will be using.
