Municipal Code Regarding Procedure for Choosing Alderman When A Vacancy Occurs

After reading the municipal code, I would suggest that the city council vote and adapt to an alternative option to fill a vacancy.

I don't like that after the mayor submits two names of which the two tries can fail, the mayor has the right to name a THIRD CHOICE person to fill the vacancy over the city council say so.

Municipal Code is state law, not something a city can change because they don't like it.

Anon 12:22 I think it is fantastic of you to respond to the municipal code regarding pro-
cedure for choosing an alderman when a vacancy occurs.
But, you must be aware or become aware that it is a Municipal Code. The city council does not have the juristictional powers to overrule the Municipal Code to vote and adapt to an alternative option to fill a vacancy. You, I, the Peru City Council or anyone else do not have the right to override a Municipal Code to fulfill their own whims. Within the last 18 months the City Council of Peru did change a long standing ordinance (to protect one of its own) which forbade a person to be associated with the liquor business and hold a council seat at the same time. Alderman Ankiewicz still retains the seat.

Peru presently has aldermen who were appointed under this Municipal Code by the past Mayor.

Too make your day a little brighter I think if you read the code again you'll realize that the Mayor does not have the right to name a THIRD CHOICE person to fill the vacancy over the city council say so. The Mayor has the long standing
legal right to appoint one of his first two choices which the council has rejected. The council does not have the privledge to appoint someone to their own peer group.

Rest assured! Mayor Harl will be fair in his nomination to the council.

Instead of stating that the mayor cannot name a third choice of replacement for Mr Wren, You better look again and listen to the city attorney. YOU ARE WRONG AGAIN.

Yes the Mayor could name on the third choice ,whomever he wants . Heaven forbid

Anon 12:23 If the ruling posted above is correct then YOU had better read it again. It clearly states "the mayor can appoint one of the two selected candidates that the council failed to approve". No where do I see that a third party can be choosen. Why are you so angry all the time?
