Illinois Law Regarding Adult Entertainment

  (55 ILCS 5/5-1097.5) 
    Sec. 5-1097.5. Adult entertainment facility. It is prohibited within an unincorporated area of a county to locate an adult entertainment facility within 3,000 feet of the property boundaries of any school, day care center, cemetery, public park, forest preserve, public housing, place of religious worship, or residence, except that in a county with a population of more than 800,000 and less than 2,000,000 inhabitants, it is prohibited to locate, construct, or operate a new adult entertainment facility within one mile of the property boundaries of any school, day care center, cemetery, public park, forest preserve, public housing, or place of religious worship located anywhere within that county. Notwithstanding any other requirements of this Section, it is also prohibited to locate, construct, or operate a new adult entertainment facility within one mile of the property boundaries of any school, day care center, cemetery, public park, forest preserve, public housing, or place of religious worship located in that area of Cook County outside of the City of Chicago. 
    For the purposes of this Section, "adult entertainment facility" means (i) a striptease club or pornographic movie theatre whose business is the commercial sale, dissemination, or distribution of sexually explicit material, shows, or other exhibitions or (ii) an adult bookstore or adult video store whose primary business is the commercial sale, dissemination, or distribution of sexually explicit material, shows, or other exhibitions. "Unincorporated area of a county" means any area not within the boundaries of a municipality. 
    The State's Attorney of the county where the adult entertainment facility is located or the Attorney General may institute a civil action for an injunction to restrain violations of this Section. In that proceeding, the court shall determine whether a violation has been committed and shall enter such orders as it considers necessary to remove the effect of any violation and to prevent the violation from continuing or from being renewed in the future.

Is it one mile from where the stages are set up to the northern most property line of Veteran's Park? Or do they measure from the property line of the airport to the property line of the park?

if it were 3,000 feet from airport property and not the event, isn't there a church on the west side of the cemetery? Or has it moved?

I think it is time to pass a law stating public property cannot be used for "adult entertainment." It is a sad state of affairs when such a law appears necessary.

I believe Lois was posting this to show how this law is completely useless for a one off performance like this. Its not a strip club, its just a wild raunchy money making concert.
Those are generally prohibited more by conscience, taste, and responsible city governance.
Which is why it has found its way here to Peru.

All elected city officials have represented Peru with representation of how they feel Peru should be showcased. If anyone believes differently and blames ignorance of the law they are expressing yet another reason that they are getting improper representation. There is no one on the present council who would be considered a "newbie" without time to do their homework for a educated decision.
As anon 7:39 PM states the success of home rule depends upon the honesty of those we elect.
All governments success depends upon those who seek office and which we vote for. Ultimately those elected depends upon you and me. Educate your opinion and vote intelligently. Presently as a active citizen with good intentions we are failing ourselves as some wards in Peru have no one running that is qualified.

Will the Uproar concert become the next "Westclox fire"? While any bad incidents at the concert won't last for days, the possibility is there to have to call in other areas for help. I hope the secret safety plan works. Because if there is a stampede or death, it will be remembered just like the Westclox fire is remembered.

Justin - you are right. But the system currently in place in Illinois encourages populist over reactions. "The People" tend to react like a herd of buffalo - often not in their own best interests. The founders of our nation created a system that would compensate for this by having equal representation in the US Senate - two from each state. This usually prevents "The People" - as represented by population in the House - from over reacting.
The State of Illinois also has a two house system. However, Senators are distributed by population. This gives an unfair advantage to large population centers like Chicago. Think of what the difference would be if there was one Senator per County. For those that will comment about Democracy; please remember we do not live in a Democracy - we live in a Republic. Read up on it if you want to know the difference.

Justin, part of the problem is that we have to many people voting that don't understand the issues and don't understand how government works. There should be some basic eligibility requirements before giving somebody a Voter ID Card. People should be required to pass a basic History and Government test every four years to coincide with the Mid-Term Federal Elections. There should also be a requirement that the potential voter be a net positive tax payer (meaning that if you receive an income tax refund that is more than you paid in during they year, you would not be eligible to vote). Likewise, if the potential voter does not file a tax return, they should loose their eligibility for that year.
This will do two things. It will prevent uninformed people from voting and will ensure that the people that have a stake in the game have the most influence on elected officials. Finally, we need to establish voting eligibility early in the year for the November elections. This will prevent the last minute "rock the vote" and other such nonsense that generally result uninformed voters.

I detect a bit of sarcasm in the 12:38 comment. But, I do agree that programs such as instant registration on election day, motor voter, and registration at non-government locations invites fraud at the worst and uniformed voters at the best.
It should not be easy to register to vote. People should have to go out of their way to do it. The same goes for voting. A legitimate and verifiable reason should be given for voting early and absentee.
Its going to be worse this year. The "Progressive" wing of the Democrat Party has a lot at stake. Let the games begin. OH... and I wish Mr. Quinn luck with living for a week on minimum wage ($330). This stunt means absolutely nothing. I'm sure he doesn't have to make rent, make a car payment, or any other expense except food. Mr. Quinn in essence is calling all of us idiots.

Registering to vote "is" easy in Illinois as it should be. Voting "is" easy in Illinois as it should be. The previous comments on the subject are either deliberately stupid or just "plain" stupid. Don't fall for it people. There is no substantial voter fraud in any state in this country. Republicans are simply trying to prevent minorities, the elderly, and the poor from voting because that demographic is most likely to vote democratic. Anybody who promotes policies that make it harder for anyone to register and harder for anyone to vote are anti-American plain and simple.

3:17 Who R U answering? If it is 7:36 U R not making any sense! From the comments 7:36 has made they are asking for less government and the ability to make their own choices.
As for the type of entertainment that the city government signed a blank check with the promoter they have themselves to blame and only themselves, not the promoter. If U R satisfied with the present city representation keep voting for them, personally I will not.
Also I would be very careful in telling someone to stockpile their arms and to wait for that utopia government that will limit their choices because that's what they want. My arms were not stockpiled when the US Government needed me I went to the foreign land and damn proud of it! What all of us were not proud of is the disgusting manner in which we were treated upon returning home. Of course you wouldn't understand because with your attitude you have truthfully never been in countries where people do not experience freedom.

At one time, the Democrat Party was for hard working blue collar Americans. In the last decade and a half, the party has shifted from hard working Americans and started supporting non-producers. The emphasis of the modern, Progressive Democrats is to mandate that working Americans subsidize the non-producers. The non-producers have learned that they do not need to work if they vote for the Progressives that redistribute wealth. This system cannot be sustained indefinitely. Eventually, the producers will learn and they will stop producing.

I heard him on the radio this morning saying that we need to hold a "gang summit" in Chicago. He also said that we need to give tax-payer subsidized jobs to these felons to pay them off so they stop shooting people.

It looks like the city of Peru already has an ordinance in place to not allow anything like the Suicide Girls to be in a location that has a liquor license.

The aldermen and mayor must not have checked the code so here is the part of the ordinance regulating such acts.

Sec. 6-115. Entertainment restrictions.permanent link to this piece of content

(a)
No licensee shall engage in or permit any of the following on any licensed premises:
(1)
Any person to engage in any topless or bottomless act, demonstration, dance or exhibition;
(2)
Any act of sexual intercourse, masturbation, sodomy, bestiality, oral copulation, flagellation or any other sexual act which is prohibited by law;
(3)
Any act of actual or simulated touching, fondling or caressing of the breast, buttocks, anus, vulva or genitals;
(4)
The display of films or photographs depicting acts, the live performance of which is prohibited by subsections (1), (2) or (3) above.
(b)
No person shall engage in any of the acts prohibited in subsection (a) above on any licensed premises.
(c)
No licensees or their agent (s) shall permit any person to remain on the licensed premises who violates any of the provisions of this section.

Lois - good find. However, I know for a fact that it has never been enforced. I've been to many a bachelor party in bars located in Peru. Strippers are always a staple of these semi-private events. They often have "stag" films also. Some of those in attendance had badges or fancy elected titles.

Because strippers are always a stable of the semi private bachelor parties you have attended does not logically indicate that they are stable for those you have not attended. It seems that you associate with those interested with this type of activities - strippers and stag movies. If a citizens arrest was made enforcing this ordinance would the person being charged be the Mayor of Peru for not enforcing the law as Peru Liquor Commissioner? This appears to be the step which needs to be taken. Maybe a Aldermen with his morals in the right place or a candidate for the next Mayors election would be interested in a citizens arrest.

The Ordinance regulates what the people can and can't do. The Government does not need to follow any ordinance because it is exempt from following the law. Our Mayor is following the example set by the leader of his Political Party. If a law is inconvenient, just use a pen and a phone and ignore it.
