PRESS RELEASE

The Peru Municipal Electoral Board will convene on Wednesday, January 2, 2019, at 5:00 p.m. to address the objection to the petition for nomination filed by Mr. David P. Potthoff. 

Mr. Potthoff is objecting to the petition of nomination filed by Mr. Aaron Buffo, who is seeking election to 4th Ward Alderman in the City of Peru. Mr. Buffo is seeking election at the April 2, 2019 Consolidated Election.

The Potthoff/Buffo hearing will begin at 5:00 p.m., January 2, 2019. The hearing, which is open to the public, will be held in the Council Chambers of the Peru Municipal Building, 1901 4th Street, Peru, IL

The complaint is evidently concerning inproperly or missing page numbers and 3 names that the complaintant  believes are incorrectly written on the petition to run as an alderman of the 4th ward.

Potthoff is objecting to Buffo's Petition because his pages were not numbered and because one of the voters who signed Buffo's petition signed using his middle initial and the name used as to register to vote doesnt have his middle initial. He objected to a few other signatures which the grounds are just as riduclous. Someone is afraid of some competition. Regardless, what started out as, what I believe, Potthoff being petty has actually exposed the pure incompetence of Alderman Potthoff and Clerk Bartley. This is a very disturbing situation because nothing was done properly. Candidate Buffo did submit his paperwork without the pages being numbered which is required. BUT what Potthoff and Bartley do after is far more aggregious. Bartley (as the local election official for Peru) was supposed to accept Potthoff's petition objecting to Buffo's paperwork. Then, Bartley was supposed to pursuant to 10 ILCS 5/10-8 send a certified a copy of the objection petition and nomination papers (papers filed by Buffo) to the chair of the Peru Electoral Board and Buffo. Bartley who is on the Peru Electoral board erroneously sent the objection petition to the LaSalle County Clerk rather than to himself or whoever is the chair of the Peru Election Board. By statute 10ILCS10-9(3) a municipal officer’s electoral board consists of the mayor, city clerk and longest serving alderman. In Peru the electoral board is Harl, Bartley and Potthoff. Potthoff’s petition objection is addressed to the LaSalle County Clerk. So two of the three members of the Peru Electoral Board (Potthoff and Bartley) don’t know where to send the objection or who hears the objection petition when the answer is them! They don’t know it’s them! That is frightening. They sit on Peru's Electoral Board and are that ignorant of the law and their duties. Because Bartley erroneously sends the objection petition to the LaSalle County Clerk, Buffo receives notice of a hearing for 1/2/19 at 12 in Ottawa when it’s not a Lasalle County Electoral Board issue. So, Buffo is waiting for notice from the Peru Electoral Board and we don’t know when he will receive that but I sure hope it’s soon because according to the News Tribune his hearing is January 2. Regardless any notice Peru sends out is not proper because by statute within 2 business days Bartley should have sent via certified mail Potthoff's objection petition to Buffo and the Peru Electoral Board. He didn't do that so the Peru Board didn’t receive the objection until after the two business days which means it’s not properly before them. As for Potthoff’s objection petition itself. Pursuant to 10 ILCS 5/10-8 his petition had to have included his interest as an objector and also state what relief he is requesting of the electoral board. His petition wasn’t even directed to the right board (Peru Electoral Board, the one he sits on) he addresses it to LaSalle County Clerk but regardless he doesn’t state his interest or what relief he wants. So his objection petition should be dismissed.
